1. Definitions

“Spark”, “we”, “us” – Spark Service GmbH

“Customer” – any natural or legal person purchasing tickets through the ticket shop.

“Ticket Shop” – the online platform operated by Spark for the sale of digital tickets.

“Organizer” – the natural or legal person organizing and conducting an event.

“Event” – any event planned and carried out by an Organizer (e.g., concerts, seminars, parties, sports events).

“Ticket” – an electronic admission document granting participation in an Event.

Spark sells tickets in its own name and on its own account, but solely for events conducted by the respective Event Organizer.

2. Scope of Application

These T&C apply to:

    • all ticket purchases through our ticket shop “event24”,

    • the use of the platform by customers, including accounts and payment processes,

    • the provision, transfer, and use of electronic tickets.

Deviating conditions of the customer shall not apply unless Spark has agreed to them in writing.

3. Role of Spark

3.1 Spark is the customer’s contractual partner and handles the commercial processing (ordering, payment, refunds).

3.2 Spark is not the organizer of the events.

The Organizer is solely responsible for execution and organization, event content, admission control, safety measures, venue rules.

3.3 Spark provides no guarantee that:

    • the event will actually take place,

    • announced artists will perform,

    • program elements will occur as scheduled,

    • capacity or admission can be granted at all times.

4. Use of the Ticket Shop

4.1 The customer agrees to:

    • provide truthful and complete information,

    • not duplicate or distribute tickets without authorization,

    • not misuse the ticket shop.

4.2 Spark may:

    • cancel orders in cases of suspected misuse,

    • block accounts,

    • reject ticket purchases,

    • make technical changes to the ticket shop at any time.

5. Conclusion of Contract

5.1 By completing the order process, the customer submits a binding offer.

5.2 The contract is concluded once Spark sends the ticket and/or invoice for the order via email.

5.3 Spark reserves the right to decline orders, particularly in cases of:

    • justified suspicion of fraudulent activity,

    • violation of terms of use,

    • technical errors,

    • overbooking.

6. Prices, Fees & Payment

6.1 All prices include the statutory value-added tax.

6.2 Spark may charge service, payment, or system fees, which are displayed transparently before purchase.

6.3 Supported payment methods are shown in the ticket shop.

6.4 Tickets are sent only after payment has been successfully received.

6.5 Refunds are issued exclusively through Spark and only in accordance with these T&C.

7. No Right of Withdrawal (§ 18 para. 1 no. 10 FAGG)

There is no right of withdrawal for leisure services with a fixed date. The customer expressly agrees that:

    • no statutory withdrawal right applies,

    • a refund is only possible in case of event cancellation or as provided in these T&C.

8. Ticket Provision and Use

8.1 Tickets are provided exclusively in digital form.

8.2 The customer is responsible for:

    • working devices,

    • a valid email address,

    • protecting the ticket from being shared.

8.3 Manipulated tickets are invalid.

8.4 Spark is entitled to block tickets in case of misuse.

9. Event Execution

9.1 The Organizer alone is responsible for the execution, quality, and content of the event.

9.2 The Organizer may adjust the program, replace artists or speakers, or modify the course of the event.

Such changes do not automatically entitle customers to a refund.

10. Cancellation, Postponement, and Changes

10.1 Cancellation of an Event

In the event of full cancellation:

    • the customer receives a refund of the ticket price including fees,

    • refunds are processed exclusively through Spark.

Spark is not liable for additional costs incurred by the customer (e.g., travel, hotel).

10.2 Postponement of an Event

If an event is postponed:

    • tickets remain valid for the new date,

    • the customer may request a refund within 30 days from the announcement of the postponement.

10.3 Changes to the Event

No refund is granted for:

    • program changes,

    • replacement of artists or speakers,

    • minor changes to location or schedule,

    • other changes that do not significantly affect the character of the event.

11. Transferability of Tickets

11.1 Tickets are transferable unless otherwise indicated in the ticket shop.

11.2 Commercial resale is prohibited.

11.3 Spark may block tickets if unauthorized resale or misuse is detected.

12. Admission & Safety

12.1 Admission rules are determined by the Organizer.

12.2 The customer must comply with the venue’s rules and the instructions of the Organizer’s staff.

12.3 In case of violations, admission may be refused without entitlement to a refund.

13. Liability

13.1 Spark is only liable for damages caused intentionally or through gross negligence. Liability for slight negligence is excluded — except in cases of:

    • personal injury,

    • claims under the Product Liability Act,

    • mandatory statutory provisions.

13.2 Spark is not liable for:

    • event-related damages or failures,

    • services of the Organizer,

    • event cancellation due to force majeure,

    • travel or accommodation costs,

    • technical issues beyond our control.

14. Data Protection

Personal data is processed in accordance with the Data Privacy Policy of Spark Service GmbH.

15. Intellectual Property

15.1 The ticket shop, its content, logos, and trademarks are protected by copyright.

15.2 Use beyond ticket purchasing is prohibited.

16. Amendments to the T&C

Spark may amend these T&C when required for technical, legal, or operational reasons.

The version valid at the time of purchase applies.

17. Final Provisions

17.1 Austrian substantive law applies, excluding its conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

17.2 The court with jurisdiction over the registered office of Spark Service GmbH shall be the exclusive place of jurisdiction for disputes arising from or related to this contractual relationship. Notwithstanding this, Spark may also sue the customer at their general place of jurisdiction.
