1. Definitions<\/b><\/h3>\n

\u201cSpark\u201d, \u201cwe\u201d, \u201cus\u201d<\/b><\/span> \u2013 Spark Service GmbH<\/p>\n

\u201cCustomer\u201d<\/b><\/span> \u2013 any natural or legal person purchasing tickets through the ticket shop.<\/p>\n

\u201cTicket Shop\u201d<\/b><\/span> \u2013 the online platform operated by Spark for the sale of digital tickets.<\/p>\n

\u201cOrganizer\u201d<\/b><\/span> \u2013 the natural or legal person organizing and conducting an event.<\/p>\n

\u201cEvent\u201d<\/b><\/span> \u2013 any event planned and carried out by an Organizer (e.g., concerts, seminars, parties, sports events).<\/p>\n

\u201cTicket\u201d<\/b><\/span> \u2013 an electronic admission document granting participation in an Event.<\/p>\n

Spark sells tickets <\/span>in its own name and on its own account<\/b>, but <\/span>solely for events conducted by the respective Event Organizer<\/b>.<\/span><\/p>\n

2. Scope of Application<\/b><\/h3>\n

These T&C apply to:<\/p>\n

    \n
  • \n
      \n
    • \n

      all ticket purchases through our ticket shop \u201cevent24\u201d,<\/p>\n<\/li>\n

    • \n

      the use of the platform by customers, including accounts and payment processes,<\/p>\n<\/li>\n

    • \n

      the provision, transfer, and use of electronic tickets.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

      Deviating conditions of the customer shall not apply unless Spark has agreed to them in writing.<\/p>\n

      3. Role of Spark<\/b><\/h3>\n

      3.1 Spark is the customer\u2019s contractual partner and handles the commercial processing (ordering, payment, refunds).<\/p>\n

      3.2 Spark is not<\/b><\/span> the organizer of the events.<\/p>\n

      The Organizer is solely responsible for execution and organization, event content, admission control, safety measures, venue rules.<\/p>\n

      4. Use of the Ticket Shop<\/b><\/h3>\n

      4.1 The customer agrees to:<\/p>\n

        \n

          \n
        • \n

          provide truthful and complete information,<\/p>\n<\/li>\n

        • \n

          not duplicate or distribute tickets without authorization,<\/p>\n<\/li>\n

        • \n

          not misuse the ticket shop.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

          4.2 Spark may:<\/p>\n

            \n
          • \n
              \n
            • \n

              cancel orders in cases of suspected misuse,<\/p>\n<\/li>\n

            • \n

              block accounts,<\/p>\n<\/li>\n

            • \n

              reject ticket purchases,<\/p>\n<\/li>\n

            • \n

              make technical changes to the ticket shop at any time.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

              5. Conclusion of Contract<\/b><\/h3>\n

              5.1 By completing the order process, the customer submits a binding offer.<\/p>\n

              5.2 The contract is concluded once Spark sends the ticket and\/or invoice for the order via email.<\/p>\n

              5.3 Spark reserves the right to decline orders, particularly in cases of:<\/p>\n

                  \n
                • \n

                  justified suspicion of fraudulent activity,<\/p>\n<\/li>\n

                • \n

                  violation of terms of use,<\/p>\n<\/li>\n

                • \n

                  technical errors,<\/p>\n<\/li>\n

                • \n

                  overbooking.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

                  6. Prices, Fees & Payment<\/b><\/h3>\n

                  6.1 All prices include the statutory value-added tax.<\/p>\n

                  6.2 Spark may charge service, payment, or system fees, which are displayed transparently before purchase.<\/p>\n

                  6.3 Supported payment methods are shown in the ticket shop.<\/p>\n

                  6.4 Tickets are sent only after payment has been successfully received.<\/p>\n

                  6.5 Refunds are issued exclusively through Spark and only in accordance with these T&C.<\/p>\n

                  7. No Right of Withdrawal (\u00a7 18 para. 1 no. 10 FAGG)<\/b><\/h3>\n

                  There is no right of withdrawal<\/b><\/span> for leisure services with a fixed date. The customer expressly agrees that:<\/p>\n

                      \n
                    • \n

                      no statutory withdrawal right applies,<\/p>\n<\/li>\n

                    • \n

                      a refund is only possible in case of event cancellation or as provided in these T&C.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

                      8. Ticket Provision and Use<\/b><\/h3>\n

                      8.1 Tickets are provided exclusively in digital form.<\/p>\n

                      8.2 The customer is responsible for:<\/p>\n

                        \n

                          \n
                        • \n

                          working devices,<\/p>\n<\/li>\n

                        • \n

                          a valid email address,<\/p>\n<\/li>\n

                        • \n

                          protecting the ticket from being shared.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

                          8.3 Manipulated tickets are invalid.<\/p>\n

                          8.4 Spark is entitled to block tickets in case of misuse.<\/p>\n

                          9. Implementation, changes, cancellation, and postponement of events<\/b><\/h3>\n

                          9.1 Spark does not guarantee the actual implementation of the event, the appearance of announced artists, compliance with the announced program, individual program parts, capacities, or admission. The organizer is solely responsible for the implementation, quality, and content of the event. The organizer is entitled to make changes to the program, replace artists, or adjust the course of the event. Such changes do not generally justify a claim for the return or refund of the ticket.<\/p>\n

                          9.2 In the event of a complete cancellation of an event, the customer will receive a refund of the ticket price including fees. The reversal of the transaction will be carried out exclusively by Spark. Further claims, in particular for additional costs or damages incurred by the customer (e.g., travel, accommodation), are excluded. This does not apply to cases of force majeure; in such cases, there is no entitlement to a refund of the ticket price or fees.<\/p>\n

                          9.3 If an event is postponed, the tickets remain valid for the replacement date. The customer may request a refund of the ticket price within 30 days of the announcement of the postponement.<\/p>\n

                          9.4 No refunds will be given for changes that do not significantly affect the nature of the event, in particular program changes, replacement of artists or speakers, adjustments to the event schedule, and minor changes to the time or location.<\/p>\n

                          10. Transferability of Tickets<\/b><\/h3>\n

                          10.1 Tickets are transferable unless otherwise indicated in the ticket shop.<\/p>\n

                          10.2 Commercial resale is prohibited.<\/p>\n

                          10.3 Spark may block tickets if unauthorized resale or misuse is detected.<\/p>\n

                          11. Admission & Safety<\/b><\/h3>\n

                          11.1 Admission rules are determined by the Organizer.<\/p>\n

                          11.2 The customer must comply with the venue\u2019s rules and the instructions of the Organizer\u2019s staff.<\/p>\n

                          11.3 In case of violations, admission may be refused without entitlement to a refund.<\/p>\n

                          12. Liability<\/b><\/h3>\n

                          12.1 Spark is only liable for damages caused intentionally or through gross negligence. Liability for slight negligence is excluded \u2014 except in cases of:<\/p>\n

                              \n
                            • \n

                              personal injury,<\/p>\n<\/li>\n

                            • \n

                              claims under the Product Liability Act,<\/p>\n<\/li>\n

                            • \n

                              mandatory statutory provisions.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

                              12.2 Spark is not liable for:<\/p>\n

                                \n
                              • \n
                                  \n
                                • \n

                                  event-related damages or failures,<\/p>\n<\/li>\n

                                • \n

                                  services of the Organizer,<\/p>\n<\/li>\n

                                • \n

                                  event cancellation due to force majeure,<\/p>\n<\/li>\n

                                • \n

                                  travel or accommodation costs,<\/p>\n<\/li>\n

                                • \n

                                  technical issues beyond our control.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

                                  13. Data Protection<\/b><\/h3>\n

                                  Personal data is processed in accordance with the Data Privacy Policy of Spark Service GmbH<\/b><\/span>.<\/p>\n

                                  14. Intellectual Property<\/b><\/h3>\n

                                  14.1 The ticket shop, its content, logos, and trademarks are protected by copyright.<\/p>\n

                                  14.2 Use beyond ticket purchasing is prohibited.<\/p>\n

                                  15. Amendments to the T&C<\/b><\/h3>\n

                                  Spark may amend these T&C when required for technical, legal, or operational reasons.<\/p>\n

                                  The version valid at the time of purchase applies.<\/p>\n

                                  16. Final Provisions<\/b><\/h3>\n

                                  16.1 Austrian substantive law applies, excluding its conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG).<\/p>\n

                                  16.2 The court with jurisdiction over the registered office of Spark Service GmbH shall be the exclusive place of jurisdiction for disputes arising from or related to this contractual relationship. Notwithstanding this, Spark may also sue the customer at their general place of jurisdiction.<\/p>\n
